If an employee has worked more than half of their total service at less than 30 business hours per week, and his average compensation used for benefit calculation purposes consists of three or more years when he worked more than 30 business hours per week, his average compensation will be calculated as the average of his highest 10 consecutive years.
Effective July 1, 2012, any newly elected municipal official, who is compensated for less than 35 hours per week, will not be allowed membership into MERS as a result of that elected position.
